View Full Version : Proposed Revision of UK Refrigerant Laws

In the UK we are all familiar with the EU ODS Regulations and the more recent F Gas Regulations. These two pieces of European law have resulted in the two UK Statutory Instruments (SIs) that describe and outline the offences and penalties, particularly with respect to refrigerant handling qualifications and the need for regular leakage checks of equipment.
With the need for a demonstration of competence for both individuals and companies operating in this field, there have been plenty of posts over the recent couple of years on these issues.

The UK govt is now consulting on updated legislation that will take into account changes in the training and certification requirements brought in by the F Gas Regs and attempt at the same time to align the legislation for both F Gas and ODS. This is due to come out next year, in 2009.

The existing SIs will be repealed at that time.

As they are required to do, they have gone out to consultation with an end date of October 3rd, 2008. This allows us to see what is likely to be in the new regulations and if we wish to, comment or suggest changes.

I highly recommend that everyone reads the list of those consulted (consultees).
Just to see if your Company is listed
were there.
I assume more info will filter out to us?
As far as I can see when this becomes Law next year we will have to have...
C&G or CITB J11 / J12 CAT ETC.
I guess everyones training budgets will be increased next year?

As ever, it?s never easy reading but the laws as they stand affect every single practitioner in the UK now and these will bring them up to date with the new requirements for competence.

It is worth pointing out that all these laws cover other industries and practices than refrigeration /air conditioning, so you have to select the texts that are applicable.

Steve, there are SIs in place now that demand either the C&G 2078 or the CITB equivalent for handling F Gas and ODS amongst a lot of other things. It?s these two current SIs that are up for revision.

After next year all practitioners will need to have the new qualification that is aligned to the F Gas regulations and the current safe handling qualifications will become a transitional qualification until about 2011, when they will be finally withdrawn. That?s my understanding at the moment because the details of the new training protocols are still being worked out. During that three year period, current holders of the safe handling certs can continue to use them while they qualify for the new ones and new entrants to the trade will go straight into gaining the new qualification.
This qualification is solely for compliance with the issues of harmonising the EU F Gas regulations and is not going to replace any existing vocational qualifications that we already have.

Anyone can be a consultee. You need to read the consultation document that are the guidelines, and then read the drafts of the two new SIs. There is three month set aside for this.

Comments should really be a concise reference to the part in question, followed by a reasoned rationale about what you think could be improved, or perhaps what has been overlooked and a suggested alternative.

The drafters are not engineers, and for the most part we are not lawyers or civil servants, but they are anxious to get a set of rules laid down that people agree with and are workable.

The other way to stay in the loop is to be a Member of HVCA,IR,Refcom etc however its strange that they don't actually consult the REAL people that matter directly and you have to find it out through a site where we talk shop.
